Alternatives To Jail

Supervised Electronic Confinement Program : Work Furlough
Work Release : County Parole : Treatment Programs

If you have been arrested then you have come to the right place. We are experienced and aggressive and have a proven success record. Our goal is to keep our clients not only out of jail, but away from the hassles of the Court system. It is not necessary to even be in the Courtroom when you have counsel representing you. When possible, which is most of the time, we find viable jail alternatives that keep families together and protect licenses and jobs.

Some of the alternatives to jail are:

1. SUPERVISED ELECTRONIC CONFINEMENT PROGRAM

The Supervised Electronic Confinement Program is where you can serve your sentence at home. This program restricts you to your residence; however, you may be allowed to work, go to school and attend medical appointments and counseling. To be eligible for this program, your jail sentence must be 30-days or longer.

If Supervised Electronic Confinement is denied, we would be glad to appeal the decision. We have successfully appealed on behalf of our clients.

2. WORK FURLOUGH

The second program worth mentioning is Work Furlough. You are able to leave jail to work or attend school. This program has several limitations and is not advisable for all, especially those who are not yet legal citizens.

Mr. Fiumara will explain the Immigration & Naturalization Services (INS), now Immigration Customs Enforcement (ICE) connection upon your request; it can have far reaching immigration/deportation implications.

3. WORK RELEASE

The third program is Work Release. This is an opportunity to avoid jail entirely! Instead, you are required to work for Sonoma County in lieu of jail on a Sonoma County Adult Work Crew, or what ever they assign you. If you are unable to do any of the physical labor, then this law firm will arrange, through the Sonoma County Volunteer Center, an appropriate job for your disability or special needs. You need a referral from the Court and a maximum 90-day jail sentence to qualify.

There are additional restrictions, for example, you must sign up for work release within 10 working days after you have been sentenced. Never call the day of your last court appearance. The date will not have been entered.

This is an excellent program, but there is no free lunch. To be given the "privilege" of participating in this program you must pay a $8.00 per day fee (subject to increase) and a $25 administration fee.

4. COUNTY PAROLE

The fourth program is County Parole. County Parole allows an early release from jail, or home confinement. However, you must have completed one-half of your jail sentence and have at least 30-days yet to serve.

For more information on these programs you can call the Sonoma County Jail and/or Adult Probation at 578-6042, or our law offices at 571-8600.
